Part 7

page 78/190

On the belt there hangs a completely crumbled smaller crown seal pressed on red wax, sewn into two round petals of old white cloth, which protect it, or rather the wax fragments left behind, from falling apart. The confirmation does not describe Kazimierz's original at all. The relevant words are: constitutus coram nobis honorabilis A.ntonius Onyhy tcladica lyremisUensis supplicavit huiniUter, ąiiatenus lileras tenoris infrascripti confirmare dignaremiir, quaarum sequiłttr tenor: Kuzimirus etc.

On the outside of the parchment there is a large title inscription, which seems to have come from the royal chancellery, "Freedom of the Duchy", and next to it there are many later inscriptions, more or less precise, giving the privilege. There is no shortage of those who understand it completely wrongly, such as, for example, this hand from the end of the 17th century. century made and ruling that this privilege was granted to the Uniates: "Rutheni tmiti ab omnibus oneribus exempti^ a mrisdiccione seculari liberi, pncificati Catholicłs, coram suis ejnscojns comjMrebimt". Another inscription from the 18th century rectifies it with the words "fauore non uniłorum".

More interesting, however, is a Polish note from the 18th century, it reads as follows: "The 'loanniki' was made into the bishop 'Iwan, Niki'; he was followed by Antoni, and this former misunderstood one was given the surname of "Oniki". From this non eruitur privilege that the Schyzraatics should serve, which is contained in it, because so far there has not been a real schism in Russia: but until after the Synod of Bresten, after 1595. But it seems that the Poles, knowing no more than their own Latin rite, condemned and persecuted everything that was not in Latin for heresy. "Let the king put a stop to this violence instilled in them by his privilege."

As for the above philological conjecture explaining the name "Onyka" with a wrong reading of the name "loannikij", it should be mentioned that it is as misleading as other legal and political views of its author. The existence of Bishop Antoni Onyka is, after all, best proven as Sigismund's privilege, and the diocesan schematism, which also calls him Onyki, puts his rule in the years 1506-1520.

') The last letters are completely erased.

^) The second half of this word is blurred to the point of being unreadable.

') Here is parchment worn to the size of a three- or four-letter word.

■•) Also about three letters worn off.

'^j The construction of this sentence Unde quia statum recognoscunt has probably been due to some mistake of the transcriber, it was completely dislocated. However, the meaning is quite clear.

*) M. Harasiewicz annales ecclesiae Ruthenae page 51 says that Casimir Jagiellończyk approved Witold's privilege with this document, we see that there is no mention of such a privilege here. And this statement reveals a tendency manifested throughout this extremely confusing work, the author of which would like to strip the Polish nobility and kings of all credit for the Russian church. Therefore, he would also like to present here this truly enormously important privilege granted by King Casimir proprio mota to the Ruthenian church as an approval of the privilege granted by Witold, about which he did not know what right he had to grant privileges to the Przemyśl church.
